This would be like a judge applying a law that was replaced by a more recent one because... reasons. This should not be permitted. In a judicial setting it would be overturned and lead to disciplinary actions. A normal functioning system would not allow absurd nonsense like this. They pick and choose not just the version of reality they want, but the actual on-the-book guidelines they prefer.
